Overview

Automata Studio LLC operates Nibilo, an AI visibility analysis platform. By using the service, you agree to these Terms of Service and our Privacy Policy.

1. Services Provided

Nibilo provides AI visibility auditing, prompt optimization analysis, competitor tracking across AI platforms, reporting, and strategic recommendations to help businesses understand and improve how they appear in AI-generated responses.

2. Subscription Plans

• Month-to-Month: Billed monthly. Cancel anytime with 30 days' notice.
• 12-Month Agreement: Billed monthly for 12 months. This is a binding commitment.
• 24-Month Agreement: Billed monthly for 24 months. This is a binding commitment.

3. Billing and Payment

Applicable activation fees are charged at signup. Monthly billing is automatic and recurring. By subscribing, you authorize Nibilo to charge your payment method on file. All fees are non-refundable except as required by applicable law. Payment is processed through secure third-party payment providers, and their terms may also apply. Failure to pay may result in suspension or termination of your account.

4. Binding Contracts and Early Termination

12-month and 24-month agreements are legally binding commitments. Early cancellation does not eliminate your payment obligations. If you cancel a fixed-term plan early, the remaining balance (100% of unpaid fees) may be due immediately.

5. Cancellation Policy

Month-to-month plans require 30 days' written notice to hello@meetautomata.com. Cancellation is effective upon confirmation from Nibilo. Fixed-term plans require full payment of the remaining balance if terminated early.

6. Acceptable Use

You are responsible for all content and data you submit to the platform. You agree not to use Nibilo for any unlawful or fraudulent purpose, to submit content that infringes on the rights of others, to attempt to reverse engineer or interfere with the service, or to misrepresent your identity or affiliation.

7. Intellectual Property

All technology, methodologies, algorithms, reports, designs, and other intellectual property related to Nibilo belong exclusively to Automata Studio LLC. During your active subscription, you are granted a limited, non-exclusive, non-transferable, revocable license to use the service and its deliverables for your business purposes. You may not copy, distribute, or create derivative works from our proprietary materials. You retain ownership of any data you submit to the platform.

8. Data Usage and Rights

Nibilo may process and analyze your submitted data to provide the service, use aggregated and anonymized data to improve the platform, and develop industry insights and benchmarks. We do not sell identifiable user data. Please refer to our Privacy Policy for full details on data handling.

9. AI and Results Disclaimer

We do not guarantee rankings, visibility improvements, traffic increases, or any specific business outcomes. Results vary based on numerous external factors beyond our control. Third-party AI platforms (such as ChatGPT, Gemini, Perplexity, Grok, and Claude) operate independently and may change their algorithms, data sources, or behavior at any time. All recommendations provided by Nibilo are informational only.

10. Disputes and Chargebacks

Please contact hello@meetautomata.com before initiating any payment disputes or chargebacks. Unauthorized chargebacks may constitute a material breach of these terms, and we reserve the right to recover all associated costs and damages.

11. Failed Payments

If a payment fails, your access may be suspended immediately. Continued failure to pay may result in termination of your account and, for fixed-term plans, acceleration of the remaining contract balance.

12. Termination by Nibilo

We may suspend or terminate your access for breach of these terms, non-payment, misuse of the platform, or if required for legal or security reasons. Termination does not relieve you of any outstanding payment obligations.

13. Indemnification

You agree to indemnify and hold harmless Automata Studio LLC, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use or misuse of the service, content you submit, or any violation of these terms.

14. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

15. Limitation of Liability

Nibilo's total liability for any claims arising from or related to the service is limited to the fees you paid in the three months immediately preceding the claim. In no event shall we be liable for any indirect, incidental, consequential, special, or punitive damages.

16. Modifications

We may update these Terms of Service from time to time. We will provide 30 days' notice of material changes by posting the updated terms on this page. Your continued use of the service after the changes take effect constitutes your acceptance of the updated terms.

17. Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict of law principles.

18. Electronic Acceptance

By clicking "Accept," completing a payment, or using the service, you agree to these terms, consent to conducting transactions electronically, and acknowledge that your electronic acceptance is legally binding.

19. Entire Agreement

These Terms of Service constitute the entire agreement between you and Automata Studio LLC regarding the use of Nibilo and supersede all prior agreements, understandings, or representations.
